What's this all about?
Welcome to terminatetherate.org - the site that you can use to voice your support for getting rid of mobile termination rates so that there can be a new era of cheaper mobile communications that'll save us all money.
So, what do you really need to know?
Terminatetherate.org is operated by 3,(a trading company of Hutchison 3G Ltd) on behalf of the Terminate the Rate Campaign Group of which BT, MoneySupermarket.com, the Federation of Small Businesses, Carers UK, the GMB (Britain's General Trade Union) and the National Union of Students are members of. The Group (Hutchison 3G UK Limited ("we/us/our") who is asking everyone to join in the campaign to get rid of mobile termination rates. We've set out below some terms, our privacy notice and some information that we think is important for you to know about your access to and use of terminatetherate.org and about you voicing your support for our petition and the personal information that you give us when supporting our petition. We know it may seem a bit tedious, but please do read it, as it does contain some important information.
So, here's the Legal bit:
By signing our petition and/or using the site you are agreeing to these terms which
include our privacy policy. We might need to amend, update and/or modify these terms
(including our privacy policy) from time to time. If we do this, we'll post the most up
to date terms and privacy policy on this page so we'd recommend that you keep checking
them from time to time in order to stay up to date. If you continue using the site, that
will be confirmation from you to us that you have accepted and agreed to the new terms
and/or privacy policy. If you don't agree to these terms or the privacy policy (or any
new terms or privacy policy if we amend them from time to time), we're afraid that you
can't sign our petition or use our site (which would be a shame as we'd love your support
but, unfortunately, rules are rules!).
Who are we?
Terminatetherate.org ("the site") is owned and operated by 3 (company number: 03885486)
("we", "our" and "us"). Our registered office is at Star House, 20 Grenfell Road, Maidenhead,
Berks, SL6 1EH. Please feel free to drop us a line at our registered office if you have any
questions about these terms, the site or if there's anything else you'd like to tell us about
in relation to the terminatetherate campaign.
Our Privacy Policy
This policy sets out our privacy practices in connection with the Terminate the Rate campaign,
including the site, and is intended to inform you about the kinds of information we may obtain
about you when you join the Terminate the Rate campaign (whether through the site, by text or
by signing a paper petition form), how we may use that information and who we may share that
information with. Reference to "the Campaign" means the Terminate the Rate campaign.
General Statement
We respect your right to privacy and we are committed to complying with applicable data
protection and privacy law. We will only collect personal information about you with your
awareness and permission. Any personal information which you provide to us and/or which we
obtain about you, will be kept secure and confidential using appropriate technical measures
and by ensuring staff are trained and aware of how to protect your data.
Collection and Use of Your Personal Information
You agree that any data you provide to us will be true, complete and accurate in all
respects and you agree to notify us immediately of any changes to it. We will only
collect personal information which is necessary to:
- process your registration for the Campaign;

publicise the Campaign and further the Campaign's purpose
of showing that consumers are in favour of abolishing the
Mobile Termination Rate. This may involve providing your
data, or information produced by analysing the data
provided by you and other members of the Campaign, to
certain third parties and displaying certain data on the
site. For further details on the use we
will make of your data for this purpose, please see
separate paragraphs below on "Use of Information Obtained
by the Campaign" and "Sharing Your Information With Third
Parties";

keep you updated, by email, about the progress of the
Campaign subject to the preference indicated by you. It's
your choice and you're in control - you can contact us at
any time to up date your preferences by sending an email to
dpa.officer@three.co.uk or by writing to or calling customer
services;
Use of Information Obtained by the Campaign
When you become a member of the Campaign (whether through the site, by text or by
signing a paper petition form) you provide us with certain information and you will
be given the chance to set your privacy preferences. Whichever method you join by,
you will be required to provide us with your full name, postcode and your email
address. We will also enter the date you joined the Campaign into our database.
If you join online, you will also have the option of uploading a photograph for
display on the site and of inviting friends to the campaign.
However you join the Campaign, only your full name and the date you joined the
Campaign will be displayed on the site. We may choose to display any photograph
you have uploaded or your responses as to why you think the Mobile Termination Rate
should be abolished. However, we reserve the right to review these either prior to,
or after, publication and we will only permit them to e published (or permit their
continued publication) on the site if we consider them to be appropriate for
publication. The information displayed on the site may also be used in promotional
literature produced for the purposes of publicising the Campaign. We will not
display your postcode or email address on the site or in promotional material,
nor will we provide these details to third parties unless we are required
to do so by law.
We will not display your mobile number and nor will we display your network in
any way that can be linked to you. We may use your network, along with details
of the networks of other members of the Campaign, to create statistics to be
used in the Campaign.
Sharing Your Information With Third Parties
The Campaign is about proving that consumers want the better value mobile phone
services that would result from the Mobile Termination Rate being abolished.
In order to do this, the information you provide to the Campaign will be provided
to certain third party organisations:
- OFCOM - for further details on OFCOM and its activities please refer to http://www.ofcom.org.uk/;
- UK Government departments;
- the Competition Commission and/or OFT and/or European Commission;
- organisations engaged to assist us in public relations campaigns; and
- to the national and local press.
We will provide information to these organisations in the form of a list of
the names of the members of the Campaign along with the dates those members
joined the Campaign. We will not provide these organisations with any other
information in a form that can be linked to you as an individual.
We may provide these organisations with statistics obtained from an analysis of all
of the information provided to us by members of the Campaign. For example,
we may give them information as to the distribution of members of the Campaign
across networks or as to the geographical distribution of members of the Campaign.
Disclosure
We may disclose your information to other members of our group of companies,
and to our or their partners, associates, agents or subcontractors and to
possible successors to our business. Some of these parties may reside outside
the European Economic Area (which currently comprises the Member states of the
European Union plus Norway, Iceland and Liechtenstein). If we do this, your
information will be treated to the same standards adopted in the UK.
We may also disclose your information for the prevention and detection of
crime and to protect our interests or those of other users or if required
to do so by law.
Retention of data
We will keep your personal information for as long as necessary for the
purposes for which it was collected, to provide you with services and to
conduct our legitimate business interests or where otherwise required by law.
Collection and use of technical information
We use "session" cookies which enable a visitor's web browser to 'remember'
which pages on the site have already been visited. We may also map and analyse
visitor usage patterns to help us develop the site and enhance a visitor's experience.
Depending on the type of browser you are using, you may be able to configure
your browser so that: (i) you are prompted to accept or reject cookies on an
individual basis or (ii) to prevent your browser from accepting any cookies
at all. You should refer to the supplier or manufacturer of the web browser
for specific details about cookie security.
We may collect and store certain 'technical information' about your visit to the
site, such as:
- the IP address from which you access the site
- the type of browser and operating system used to visit the site
- the date and time of your visit(s) to the site

clickstream data which reveals the activities of visitors around the
site (for example the pages you access and products browsed) and
- the website address of the website from which you accessed this site.
None of the technical information we collect could be used by us to identify
visitors to the site. Such data are used only to analyse trends, administer
and improve the site, track movement through the site and gather statistical
information about visits to the site.
Access to your personal information
You have the right to request a copy of any personal information we hold about you
and to have any inaccuracies corrected. We will charge an administrative fee of £10
to provide a copy of any data held. Please write by sending an email to

Monitoring of Your Communications
We may monitor and/or record communications between you and us for quality control
and training purposes.
Your Eligibility
Unfortunately, if you are under 16 years of age, you aren't eligible to sign our
petition, however, you are still welcome to take a look around our site at the
information on it. By signing our petition or registering your details on the site,
you are representing to us that you at least 16 years of age and that you agree to,
and will comply with, these terms.
Where are you?
Why do we ask? Because our site and our campaign is really aimed at UK residents so,
if you're not based in the UK, some of the information may not be appropriate or
available to you. Also, these terms are subject to English law unless you live
in Scotland, in which case, they are governed by Scots law. Each of us agrees to
only bring legal actions about these terms in a UK court.
Getting It Right
Whilst we do make a real effort to ensure the accuracy and reliability of the
contents of this site, you should note that the content is provided on an
"as is" basis. You shouldn't assume that the information contained in this
site is error free (even though we do try hard to get things right). Also,
if you do happen to spot anything that you think is not accurate or up to date,
please do let us know by contacting us (you can use any of the methods we've set
out under the "Hi there! - Getting in touch with us" section of these terms).
What we need from you
Your support!! Plus, in order to use our site and/or to register your support
for our petition (via whatever method you choose), we need you to agree to
these terms.
By using the site and/or registering your support for our petition, you agree:
- to provide us with accurate, current and complete information about you in any forms
on the site where you sign our petition or register details with us;
- not impersonate any person or entity, or falsely state or otherwise misrepresent yourself,
your age or your affiliation with any person or entity;
- not to do anything which will or might damage, disable, interfere with, disrupt access to,
interrupt or impair the functionality of the site or any content or links on the site;
- not to do anything that is unlawful or which may cause any liability for us;

not to post, share, transmit, distribute, store, upload or otherwise make available:

any threatening, abusive, inflammatory, intimidating, harassing,
vulgar, fraudulent, defamatory, offensive, infringing, obscene, indecent or

code, files or programs designed to interrupt, destroy or limit the
functionality of any computer software or hardware or communications

any content that, in our sole opinion, is objectionable or which
restricts or inhibits others from using or enjoying the site or
which may expose us or any users of our site to any harm or liability
(of any type);

any content that you did not create or that you do not have permission to post;

not to harvest, solicit or collect any contact information of other users of
this site by electronic or other means for the purposes of sending unsolicited

deal with your comments, photos, other content or information (other than those
personal details which are not for public display) you send, post, transmit,
upload, display or publish on the site and we will be free to keep and republish
this information and reuse it as we see fit (including, but not limited to,
display or publication on the site, promotion & publicity of the site and the
"terminate the rate" campaign, presentation of our petition to UK regulatory
bodies, UK government, European Commission for lobbying, public relations
(including national and local press/media) and analytical purposes connected
with the "terminate the rate" campaign);

post, transmit, upload, display or publish on the site;

we may, but we aren't obligated to, review the comments, content or other
information posted by you and other users on the site. However, we may delete
or remove (without notice) any comments, photos, content or other information

offensive, illegal, objectionable or may infringe the rights, harm or threaten the
safety of other users of the site. We may also notify law enforcement authorities
if such content or information is illegal or in any way unlawful;

of the Hutchison Whampoa Limited group - this is the group of companies
that we are part of) belongs to us or is licensed to us for our use and may
not be used without our written permission. We reserve all of our rights.
Why is it important that I keep to these terms?
If we reasonably believe that you have breached any of these terms, we reserve
the right to:

contact you to warn you that you have breached these terms,
and ask you to stop such conduct; or

if your breach of these terms is serious or, in our reasonable opinion, we believe that your breach of our terms has not been, or is unlikely to be, rectified, we may:

prevent you from using our site; and/or
-
remove any comments, photos, other content or information that you
have sent, posted, transmitted, uploaded, published or displayed
from the site; and/or

exclude your details from being included in our petition; and/or
-
ask you to reimburse us for any loss, damage, costs and expenses
we incur which are caused by your conduct in supporting our petition
or your use of our site.
What aren't we responsible for?
THIS SECTION IS VERY IMPORTANT, SO WE'D ASK YOU TO READ IT CAREFULLY.
All of our obligations to you relating to our petition and this site are set out in
these terms.
Nothing in these terms removes or limits our liability for fraud, death or personal
injury which is caused by our negligence or for any liability we can't be excluded or
limited by law. If you are a consumer, your statutory rights are not affected -
for more information on your statutory rights, contact your local authority
Trading Standards Department or Citizen's Advice Bureau.
Except as we've set out above:

all other terms, conditions and warranties relating to our petition and this
site are excluded;

our entire liability to you for something we do or don't do will be limited
to £500 for one claim or a series of related claims; and

we are not liable for any injury, loss, claim, damage, or any indirect,
incidental or consequential damages of any kind (including but not limited
to lost profits, lost savings or revenue, or loss or corruption of data or
information) which arises out of or is in any way connected with your support
for the petition or use of this site;

we are not liable for any loss or damage that was not reasonably foreseeable
when you entered into this agreement with us;

we accept no responsibility for any use of, or reliance on, the site or
its content;

we do not make any representations as to the accuracy, comprehensiveness,
completeness, quality, currency, error-free nature, compatibility,
security or fitness for purpose of this site (including its content)
which is provided to you on an "as is" basis;
